On the 17 June 2010 the NSW Parliament passed the Residential Tenancies Act 2010 (the 2010 Act), which is due to commence in January 2011, and repeal the current 1987 Act. The Supporting Regulations to the 2010 Act are expected to be finalised by the end of December 2010.

The 2010 Act incorporates a complete revamp of tenancies law in NSW and defines areas of law which have caused confusion in the past for both Landlords and Tenants. Its aim is to balance the rights of all parties to residential tenancies, and incorporates new provisions to deal with the effects of Domestic Violence Orders on Tenants and Landlords bound by existing leases.
